Are cannabis products legal or not in Spain? There is no short answer. That is why we have summarized the most important rules for you below.
Novel Food Regulation
A very important part of modern Spanish legislation is the Novel Food Regulation. This means that some novel foods are restricted by rules. Unfortunately, cannabis oil also falls under this regulation.
Anyone familiar with the European Union rules will immediately object that the Novel Food Regulation is not mandatory for all countries. Each country is free to determine whether it adheres to this regulation. Nothing is less true. But Spain has chosen to adhere to these rules. In short: no free Spanish cannabis market.
As a result, the legal status of cannabis oil in Spain is not very good. The government has required sellers to halt trading. Cannabis oil was absolutely no longer allowed to be advertised. This applied not only to physical stores, but also to providers of CBD products on the internet. This made it virtually impossible for manufacturers to make products such as CBD oil or CBD softgels. After all, they no longer made any money.
Difference between CBD products
But please note: this legislation only concerns CBD products that the user ingests. CBD oil is entered through the mouth and is therefore included here. But CBD cosmetics, for example an ointment that is applied to the skin, are not included. In other words: these products may indeed be sold in Spain, and are therefore available in stores everywhere, both physically and online.

In addition, the rules about weed are also in a gray area. In theory, you can grow weed at home. That certainly applies to strains that are full of CBD. Those who find that too much work can choose to buy hemp buds in so-called cannabis clubs. They are located in the major cities, such as Barcelona and Valencia.
However, important conditions apply here. First of all, only cannabis strains that are certified according to the European Union may be used. And they should never contain more than 0,2 percent THC. Finally, cultivation may only be done for the production of seeds and fibers. You need a permit for CBD extraction.
